Program Purpose / Objectives
The purpose of this CME activity is to identify and discuss successful methods for mediating and negotiating disputes arising from the delivery of health care.
Preliminary Objectives for Activity:
At the conclusion of this CME activity, participants should be able to:

  2. Distinguish ADR strategies from traditional litigation
  3. Explain interest-based negotiation
  4. Explain principled negotiation
  5. Distinguish between interest and positional negotiation strategies
  6. Outline basic mediation techniques
  7. Identify basic negotiation strategies in mediation
  8. Apply negotiation strategies to primary provider patient care
  9. Describe the use of conflict resolution strategies in consultation liaison services
  10. Explore conflict resolution strategies in Medical Ethics Committee Activities
  11. Describe the role of mediation in resolving provider patient disputes
  12. Recognize the potential of conflict resolution strategies to address other healthcare issues.

Faculty
Gregory Firestone, PhD

Gregory Firestone, PhD is the Director of the Conflict Resolution Collaborative in the University of South Florida (USF) College of Medicine. Dr. Firestone served on the faculty of the USF Department of Psychiatry and Behavioral Medicine for twenty-five years and the USF College of Public Health for seven years. He has taught such subjects as negotiation, conflict resolution, interpersonal communication, mediation, behavioral medicine, dispute resolution system design, and inter-professional ethics to medical students, graduate students, residents and/or post graduate professionals.

Dr. Firestone is a licensed psychologist, mediator, negotiation and mediation trainer, and dispute resolution system consultant. He is 1) a Florida Supreme Court certified appellate, circuit court, dependency and family mediator, 2) an Association for Conflict Resolution (ACR) Advanced Practitioner and 3) a Diplomate Member of the Florida Academy of Professional Mediators. Gregory Firestone, PhD serves as primary trainer for numerous mediation certification courses approved by the Florida Supreme Court and/or ACR. He served on the Florida Supreme Court Alternative Dispute Resolution Rules and Policy Committee for twelve years (including seven years as Vice Chair). He currently serves on the Florida Supreme Court Alternative Dispute Resolution Rules and Policy Committee (including seven years as Vice Chair). Dr. Firestone also serves on the Editorial Board of Family Court Review and has served on the boards of various state and national mediation organizations.

Gregory Firestone, PhD has extensive healthcare delivery experience including more than 25 years of independent clinical psychology practice, clinical practice within a multi-specialty medical clinic, and affiliate staff service in numerous hospitals. He was the Mediation Consultant for FMQAI, the Florida Medicare Quality Improvement Organization and helped implement the Medicare Beneficiary Mediation Program in Florida. Dr. Firestone designed the FMQAI Comprehensive Complaint Resolution Program which received national attention for promoting a system of collaborative approaches for resolving Medicare beneficiary complaints with healthcare providers, hospitals, and nursing homes. For seven years, Dr. Firestone mediated Medicare beneficiary complaints involving Medicare beneficiaries and the providers.

Dr. Firestone lectures nationally and internationally on negotiation and mediation and has conducted mediation training for courts and/or government programs throughout the U.S. and internationally. He is coauthor of Mediation Works: Make It Work For You, a mediation orientation video published by the Florida Supreme Court and has published numerous articles on negotiation and mediation. Dr. Firestone has received the 2012 Florida Supreme Court Sharon Press Excellence in Alternative Dispute Resolution Award, the 2011 Florida Academy of Professional Mediators Award of Merit and the 2002 Association for Conflict Resolution Presidential Award.
